What is paralegal?

WoW, At times we here at SGFTVOCAP/S headquarters wished our readers would be like the anti-vax community and just blindly accept what we write. So many questions…

We are just joking of course. Questions are what make intelligent people intelligent.

The basis of all the questions we were asked yesterday? What the heck is paralegal?

Ok, cuppa and bikkies time. We have discussed this and decided that Earl Grey Tea and a few Melting Moments are the preferred option.

 

First and foremost, there are two paralegal facebook pages. There is an open page, where anyone can post and read (https://www.facebook.com/ParalegalFoundation/).

Then there is the special closed paralegal group that our anna belonged to (https://www.facebook.com/groups/1157195147642280/). Yes we said belonged. As noted yesterday two of her profiles were removed.

Paralegal, or to use its full title, the Australian Paralegal Foundation is a sham entity.

Australian Paralegal Foundation was originally set up by Drazen Jovica. You will note that Drazen goes by the name Danny. It appears that ‘cowards hiding behind fake names’ is a standard that our anna does not hold her friends to. But since our anna is currently using an account in the name of Karen Liverpool in the paralegal page…pot,kettle,black?

Actually, Drazen did not originally set up Australian Paralegal Foundation. He set up Expats Association (ABN 34625016087), a charity registered non-profit organisation. Australian Paralegal Foundation was just one of the names that Expats Association operated under on the internet.

Expats Association operated several webpages. The main ones for this discussion are expats.org.au and para-legal.org.au.  As well as facebook pages also titled Expats Association  and Australian Paralegal Foundation.

Expats Association was a charity registered Non-profit Organisation set up to:

  1. To provide an information resource to aid Australian Citizens abroad who find themselves in difficulties.
  2. To provide support and advice for Australian Citizens abroad who find themselves in difficulties.
  3. To operate as a not for profit organization to provide support and aid for it’s members.

These points are quotes directly from the Expats Association Constitution (including spelling mistakes).

We have gone back as far as we could in both the Australian Paralegal Foundation website and facebook pages and can find no evidence that either entity were providing any information, support or advice for Australians outside of Australia as set out in the Constitution of Expats Association.

The Expats Association is now delinquent in their charity registration, having not provided an Annual Information Statement (AIS) for 2015. The AIS is currently 10 months overdue. Also the expats.org.au website is dead in the water, and has been for quite some time. The Expats Association charity registered non-profit organisation appears to have been abandoned.

Oddly enough on the 27th January 2016 Drazen registered Australian Paralegal Foundation (ABN: 67709523520) as an ‘Other Unincorporated Entity’.

So you would think that Australian Paralegal Foundation is now a separate entity to Expats Association.

You would think, but no. The website para-legal.org.au is still registered to Drazen Jovica of Expats Association (ABN 34625016087),

As an entity registered to a charity registered non-profit organisation there is a (legal?) requirement for the entity to conform to the objects as set out in the constitution of the charity on which it is based.

Australian Paralegal Foundation does not, and has never conformed to the objects as set out in the constitution of Expats Association. The only information available on the paralegal facebook page is information about family court, about the corruption of police/courts/politicians and anti-vaccination rhetoric.

Australian Paralegal Foundation is a sham, set up with no intent other than to provide invalid legal advice to people who do not question the information provided to them.

We have always wondered why an entity set up to provide ‘legal advice’ needs to hide themselves in a closed group. What is so important that the group’s discussions need to be hidden from view? Even the page description states that “This group is the public group of the Australian Paralegal Foundation”. And let’s not forget that they are offering legal advice “NOTHING IN THIS FORUM IS TO BE CONSTRUED AS LEGAL ADVICE”.

No wonder our anna found a home in paralegal. She fitted in so well with the others who live in there

The point is now mute of course since anna’s ‘anna stancombe’ and ‘anna stanconde’ were removed from the paralegal page.

‘karen liverpool’ is still there though, so our anna is still lurking in the paralegal group. Plus whichever of our anna’s other aliases she has created.

 

UPDATE: 28/03/2018

We recently received communication from Danny Jovica who has made the following statement.

Hello,

I have just noticed the defamatory post you have made against me and the Australian Paralegal Foundation.

To avoid unnecessary legal action, please confirm that you will willingly remove this post immediately.

As Danny/Drazen has not noted what within the post he feels is ‘defamatory’ it is a little difficult to determine what Danny/Drazen has issue with.

We do find it odd that Danny/Drazen states that he has ‘just noticed the defamatory post‘ as Danny/Drazen was made aware of this post when it was published on the 5th of December 2016, and even went to the effort of providing a quite lengthy, detailed reply to this post on his Paralegal Facebook page on the 6th of December 2016.

Even the opening line of Danny/Drazens’ response was

Rob Sudy has brought this blog to my attention.

Sixteen months is a very long time, so we are not sure what point that Danny/Drazen is trying to achieve by making such a false claim.

UPDATE 2: 08/04/2018

Oh dear.

As a follow up to our last communication with Danny/Drazen we have now been informed that Danny/Drazen has made a Digital Millenium Copyright Act (DMCA) takedown request to WordPress as Danny/Drazen feels that our use of the Australian Paralegal Foundation Name and Banner infringes on his legal rights.

We were confused by Danny/Drazen’s DMCA takedown request as everything we have published is freely available, public information. We have made no attempt to claim ownership of any of the information displayed, as all information used and displayed is correctly identified as being credited to the ABN holder, Drazen Jovica.

For example, the use of the banner from the Australian Paralegal Foundation Facebook page is allowed under the Facebook Statement of Rights and Responsibilities (https://www.facebook.com/terms.php) which are very clear about anything published that is publicly available:

4. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of Facebook, to access and use that information, and to associate it with you (i.e., your name and profile picture).

We have been advised that WordPress has reviewed this post and found it NOT to be in breach of DMCA as claimed by Danny/Drazen.

We are still awaiting a response from Danny/Drazen as to what he felt was ‘defamatory’ on our post. As we have always stated, we are happy to correct any error we may have made.
